FESTIVAL RULES AND REGULATIONS

 

1. Organiser
ARTmania Festival 2024 is organized in partnership by ARTmania Events ( RO26020184, J32/778/2009, Sibiu, str. Gheorghe Asachi nr 11, Sibiu county), ARTmania Cultural Association, and ARTmania Agency. The partnership is collectively referred to in this document as the organizer.

2. Festival
The 17th edition of ARTmania Festival (referred to in this document as the ”Festival”), dedicated to music and art lovers, will take place in Piata Mare and ther locations situated in the old city of Sibiu (festival area).

The three days of concerts, exhibitions, cultural events and creative activities will take place on 26 (Friday) and 27 (Saturday) and 28 (Sunday) July 2024. Evacuation of the general public from the festival area will take place on each of the three days, starting at 17:00. Access for attendees will be allowed from 18:00 until 00:00 for Friday and Sunday.

(Throughout this document, the term festival coordinates will refer to the duration and area of the festival together.)

At ARTmania Festival 2024, fans will be able to listen to some of the most popular rock & metal artists of the moment.

The program is subject to change due to the international air traffic situation, the increase in the number of infections with new variants of the SARS-Cov2 virus and other unforeseen or force majeure events.

 

3. Other terms
Unless a broader or, where appropriate, depending on certain factors, a narrower meaning is provided for in this document, the terms used have the following definitions:

pass – a nominal (non-transferable) certificate, issued by the organizer in paper or electronic form against a fee, granting the attendee the right to attend the festival for its entire duration.

Adult – a parent or guardian of the child or minor accompanying him/her to the festival, any person over 18 years of age who meets the festival admission requirements.

Ticket – a nominal (non-transferable) certificate, issued by the organizer in paper or electronic form against a fee, granting the attendee the right to attend the festival on one of the three days.

Wristband – a certificate (non-transferable) issued by the organizer when the ticket, pass or invitation is exchanged, by which the organizer grants the attendee the right to enter the festival area for one day or the whole festival, depending on the document exchanged.

Child – an attendee in the festival or in one of the days of the festival who, on or before 26 July 2024 (if attending the whole festival or only the second or third day of the festival), or on or before 24 July 2024 (if attending the first day of the festival), will NOT have reached the age of 12.

Info Point – the information point for attendees about the festival, where they can exchange their tickets, passes or invitations for wristbands.

Invitation – a certificate identified by a number and/or a series of orders, issued by the organizer on paper or in electronic form, granting the attendee the right to attend the festival on one of the three days or for the entire duration of the festival.

Merchandise – any non-perishable consumer goods sold at the festival (e.g. T–shirts and other clothing products, CDs/DVDs/vinyl records) that can be purchased at the festival.

Minor – an attendee in the festival or on one of the festival days who, on or before 26 July 2024 (if attending the whole festival or only on the third day of the festival), or on or before 24 July 2024 (if attending the first day of the festival), will NOT have reached the age of 16 and who is NOT a child.

Prohibited items – goods, products, materials, substances, etc., whose possession is prohibited during the festival.

Partner – a natural or legal person carrying out activities within the festival, based on a legal relationship with the organizer.

Attendee – a person who attends the festival as a ticket/pass purchaser or as a recipient of an invitation.

Disabled person – an attendee of the festival or one of the days of the festival who holds a disability certificate valid on the day of the festival.

Person under 18 years of age – an attendee of the festival or one of the days of the festival who, on or before 26 July 2024 (if attending the whole festival or only the third day of the festival), or on or before 24 July 2024 (if attending only the first day of the festival), will NOT have reached the age of 18 and who is NOT a minor or child.

The policy on processing and protection of personal data – the totality of the conditions under which the organizer processes your personal data, available on the website www.artmaniafestival.ro.

Product – any good for immediate consumption sold at the festival (examples: food, alcoholic drinks, non-alcoholic drinks, merchandise).

Service – any other service that does NOT represent the transmission of a product or merchandise item, performed during the festival.

Organiser’s website – www.artmaniafestival.ro.

Websites of authorised sellers – the websites of authorised festival ticket sellers, namely www.artmaniafestival.ro, www.iabilet.ro, www.livetickets.ro.

Terms and conditions – the totality of the rules imposed by the organizer to the attendees, starting from the purchasing the ticket/pass or receiving the invitation and until leaving the festival area, following the end of the festival. The purchase of a ticket/pass or the use of an invitation represents acceptance of all terms and conditions, and violation of these rules will, unless otherwise provided, result in eviction from the festival area, as the organizer reserves the right to refer to the competent authorities in case of antisocial acts.

The terms and conditions may be modified up to the closing time of the festival, but only as a result of legislative changes (in a broad sense, including incidental acts of local government), in well-justified situations (in which the organizer assumes to make every effort to limit/eliminate any possible inconvenience that may be caused to attendees), as well as in case the organizer decides to extend rights within the festival (e.g.: introduction of additional, alternative payment systems), in all cases the organizer will take all necessary measures to inform the attendees in due course. Changes in the price of tickets/passes (see 4.3. below) do not constitute a change in the terms and conditions.

 

4. Access to ARTmania Festival 2024

4.0. Tickets, passes and invitations are NOT transferable and can only be used by persons who have purchased or received them, respectively, during the festival.

4.1. Tickets and passes can be purchased at one of the authorised ticket sellers’ sales points or on their websites.

Tickets and passes can also be purchased from the organizer’s website: the stakeholder will create an account (in which he/she will enter his/her full name, e–mail address and phone number), after which he/she will be redirected to the payment processor’s website, where he/she will enter his/her credit card details for online payment.

The payment processor is the NETOPIA mobilPAY platform, whose website you are kindly requested to visit in order to read the Terms and Conditions and Privacy Policy.

With regard to these data, for which please read the “Policy on the processing and protection of personal data”, the stakeholders are obliged to provide them correctly and completely, as the organizer reserves the right to refer to the competent authorities if false information is provided or any other kind of fraud is attempted.

Once the procedure on the website has been completed and payment has been confirmed by the payment processor, the attendee will receive an e–mail containing the ticket(s) and/or pass(s), which can be retrieved at any time from his/her account on the website.

The ticket purchased on the artmaniafestival.ro website will be provided through the livetickets.ro ticketing platform, whose website you are kindly requested to access in order to read the Terms and Conditions and the Personal Data Policy.

4.2. Persons purchasing tickets or passes are kindly requested to check the veracity of the ticket at the time of purchase and, in case of any suspicion, should immediately notify the organizer at [email protected].

Subsequent complaints will NOT be considered.

ARTmania will NOT grant compensation in case of alleged fraud.

4.3. The organizer reserves the right to change the price of tickets or passes at any time (such as upon completion of a promotional period), and stakeholders should check the organizer’s website or those of authorized sellers (where prices are displayed) before purchasing. Changes in ticket/pass prices DO NOT affect persons who have confirmed payment prior to the change.

4.4. Once purchased, tickets and passes may NOT be returned. The value of the tickets or passes purchased can only be refunded in the event of cancellation of the festival by the organiser for reasons NOT covered by force majeure (any external, unforeseeable, absolutely invincible and unavoidable event).

4.5. Tickets and passes, as well as invitations, will be scanned and, after confirmation of their validity, exchanged for wristbands upon access to the festival, for one day, respectively pass. An Info Point will be open every day of the festival from 12:00 to 00:00 and on Thursday 25 July from 16:00 to 21:00. 

The Info Point staff is entitled to ask any ticket/pass/invitation holder to present an ID card with the date of birth.

The wristbands are NOT transferable, ensuring access to the festival (in the concert area and those where the related events take place) only to the person to whom they have been issued after the ticket/pass/invitation has been exchanged.

Wearing a wristband is mandatory throughout the festival and can be checked at any time, both in the perimeters of access to the festival area and inside the festival.

Breaking, damaging or losing the wristband will cancel the right of participation and access to the festival area. To re–enter, a new ticket will have to be purchased and exchanged for a new wristband.

The rules on wristbands, shown in the previous four paragraphs, apply to all attendees, regardless of age, with the exception of the one in the immediately preceding paragraph, which does not apply to children.

 

5. Access for certain categories of attendees
5.1. Children have free access to the festival or to a day of the festival, only if they are accompanied by an adult who will have purchased a ticket/pass or who is the recipient of an invitation.

Child – an attendee in the festival or in one of the days of the festival who, by 26 July 2024, inclusive (if attending the whole festival or only the third day of the festival), or, respectively, by 24 July 2024, inclusive (if attending the first day of the festival only), will NOT have reached the age of 12.

Minor – an attendee in the festival or in one of the festival days who, on or before 26 July 2024 (if attending the whole festival or only the second day of the festival), or on or before 24 July 2024 (if attending the first day of the festival), will NOT have reached the age of 16 and who is NOT a child.

Person under 18 years of age – an attendee of the festival or one of the days of the festival who, on or before 26 July 2024 (if attending the whole festival or only the third day of the festival), or on or before 24 July 2024 (if attending only the first day of the festival), will NOT have reached the age of 18 and who is NOT a minor or child.

Upon prepayment of the ticket/pass/invitation, the adult is obliged to present at the Info Point a copy of the child’s birth certificate and the completed and signed standard declaration (the standard declaration is on the last page of this document).

The child will receive a wristband, on which the adult will write his/her phone number.

The child may NOT enter the festival area unaccompanied by an adult.

Also, the child will NOT be allowed to leave the festival area unaccompanied by an adult, except in special situations, such as the evacuation of attendees or part of the attendees or medical cases (situations in which they will be accompanied by medical staff).

It is recommended that children under the age of 10 wear protective headphones or earplugs. The organiser DOES NOT encourage the presence of very young children at such events, where high noise levels could create negative effects on their hearing.

The adult is responsible for the child’s safety.

Access with baby carriages is prohibited. Instead, access to the perimeter of the event is allowed with food for small children, including powdered milk, a litre of water for children aged 0–2 years, bottles or nappies.

5.2. Minors may attend the festival if they have purchased a ticket/pass or have received an invitation, if and only if they are accompanied by an adult who has purchased a ticket/pass or is the recipient of an invitation.

At the time of the pre–payment of the pass or ticket, the adult is obliged to present at the Info Point a copy of the minor’s birth certificate and the completed and signed standard declaration (the standard declaration is on the last page of this document). If the minor is at least 14 years old, the presentation of the birth certificate by the adult will NOT be necessary, the minor will have to present his/her identity card.

Minors may NOT enter the festival area unaccompanied by an adult.

Also, the minor will NOT be allowed to leave the festival area unaccompanied by an adult, except in special situations, such as the evacuation of attendees or part of the attendees or medical cases (situations in which he/she will be accompanied by medical staff). The adult is responsible for the safety of the minor.

5.3. Persons under 18 years of age may only attend the festival if they have purchased a ticket/pass or received an invitation.

5.4. People with disabilities have free access to the festival.

If the disabled person is classified as severely disabled with a personal assistant, he/she will be accompanied by an assistant, who will also have free access.

Persons who require the assistance of an attendant will NOT be given the wristband unless accompanied by a personal assistant. Persons who do NOT require a personal assistant will be granted a free wristband only for themselves and NOT with another person.

In order to obtain the wristband, the disable persons will have to appear in person, during the same dates and the same time slot mentioned above, at the Info Point, where they will show a valid ID card and a certificate of disability.

The disabled person and possibly his/her personal assistant will be given a wristband corresponding to the day(s) they wish to access the event. 

6. Prohibitions

6.0. Attendees are required to undergo a cursory body check and allow baggage checks, and those over 14 years of age must carry a valid ID at all times to prove their age.

The organizer reserves the right to deny access or possibly to evacuate from the festival:

– persons refusing security screening,

– aggressive persons,

– persons under the influence of drugs or alcohol,

– persons who exhibit forms of violent behaviour or who disturb other attendees,

– persons who behave in a way that is contrary to the smooth running of the festival,

– persons who are suspected of endangering other attendees or the smooth running of the festival,

– children and minors unaccompanied by an adult (access of these persons to the festival area will be forbidden, but if they are already in the festival area, children/minors will not be evacuated, the organizer will immediately inform the police authorities if the adult cannot be contacted at the phone number written on the child’s wristband).

Each attendee is obliged to behave in a civilized manner towards all other persons present at the festival, in a way that does not prejudice the rights and legitimate interests of other attendees, artists, the organizer and its partners.

Attendees are asked to keep a close eye on their children and/or minors and NOT to leave their belongings unattended.

Attendees are also asked to be vigilant and, if they notice any incidents that may endanger attendees, their property or the festival, to immediately contact the nearest representative of the organizer or security agent.

Each attendee is responsible for any damage caused, and the organizer is NOT responsible for any loss, theft, damage (partial or total) or any other action/omission on the part of a third party (including a partner’s representative) which results in the diminished value of an asset (including the photo/video equipment of members of the press).

6.1. The organizer will always be at the disposal of the attendees to help maintain a good atmosphere and to avoid possible unpleasant situations.

In this regard, the organizer reserves the right to temporarily block the access of attendees to certain perimeters, if it considers that these perimeters have reached the maximum capacity in which the festival can safely take place.

The organizer is NOT responsible for the deterioration of the health of any attendee, caused by a pre–existing condition, combined with the specific elements of such a festival (examples: crowds, noise, lighting equipment).

Also, the organizer is NOT liable for any deterioration of the health of any attendee as a result of the action/omission of another attendee, partner or other person who is not in any relationship with the organizer.

6.2. It is forbidden to enter the festival with:

pets,

consumer products brought in from outside the festival area (e.g. food, soft drinks, including water, alcoholic beverages), except for those intended for children aged 02 years, e.g., but not limited to, pre-packaged and sealed food and drink intended for infants, powdered milk, 1 L of water for each child aged 02 years)

psychoactive substance,

any kind of blunt objects or objects that can be considered dangerous, bladed weapons, knives, chains, etc.,

pyrotechnic materials, substances or products,

sprays (including self-defence sprays), other than disinfectants and sunscreen creams/sprays, in a maximum weight/litre of 100 ml

– any kind of glass (including perfume or cream bottles) or metal containers, except those of a weight/litre not exceeding 100 ml

– cosmetics containing flammable liquids,

– lasers or Chinese lanterns,

– plastic jugs, cans, beverage cans, except baby bottles

umbrellas (foldable or not),

banners supported by sticks,

large filming or photographing accessories other than those mentioned in point 6.4, any kind of tripods, removable blitzes (any kind of shooting with a blitz or by any other means that may disturb the smooth running of the festival or other attendees is forbidden),

any substances prohibited by law.

6.3. It is also forbidden to enter the festival with:

luggage larger than 50x30x20cm

helmets for motorcycles, bicycles, scooters etc.,

strollers, skateboards, scooters, bicycles, etc. chairs (normal or folding),

NO storage space for prohibited or bulky items. 

6.4. Access to the festival is allowed with:

medicines issued on the basis of the corresponding medical prescription (document to be presented if requested by the organiser),

hand disinfectant, disinfectant sprays in a quantity of maximum 100 ml

perfumes and other cosmetics in a quantity not exceeding 100ml

sun protection creams and sprays in a quantity of maximum 100 ml 

one litre of water for children aged 0 2 years

raincoats (in case of rain),

specific wheelchairs (for persons with loco-motor disabilities),

cameras, including professional DSLRs (the organizer reserves the right to determine places/areas where photography and filming are prohibited; in case of noncompliance, the organizer has the right to collect the camera/video strictly for the purpose of deleting the respective recordings, it being at his/her discretion whether to order the evacuation of the attendee(s)), with a single lens

luggage with maximum dimensions of 50x30x20cm.

Concerning the consumer products, ARTmania Festival 2024 will provide attendees with a specially designed food area, which will operate throughout the festival. Thus, those arriving in Sibiu’s Main Square will be able to enjoy a space dedicated to food and drinks, available for all tastes and ages.

6.5. Attendees are forbidden during the festival any form of economic activity of any kind (including the promotion of their own services or those provided by another person) or advertising, demonstrations, manifestations and rallies of any kind, distributing leaflets, attempts to 

indoctrinate other attendees, as well as any other manifestations of behaviour that may affect the smooth running of the festival or the good mood of other attendees.

6.6. The sale of cigarettes and alcoholic beverages to minors is prohibited. The organizer and its partners have the right to ask any attendee to present an identity document proving his/her age.

 

7. First aid area

The first aid area will be located outside the perimeter of the festival and will be visibly marked for all attendees.

If the attendee is unable to travel, he/she is requested to ask for help from the nearest representative of the organizer or security agent.

 

8. Payment at ARTmania Festival 2024

During ARTmania Festival 2024, the method of payment for Products and Services offered during the Event are Payvent Tags, in the form of cards. The Payvent Tag is an RFID technology based on Cashless payment technology provided by our partner Payvent. The tag does not contain confidential cardholder information and cannot be considered as a debit/credit card or cash payment equivalent.

By taking up the Payvent Tag, Attendees agree to the provisions of use in the set of “Terms and Conditions for the Payvent Tag”, available for consultation link, integral part of these Rules, and accept them as they are stated.

The Payvent tag is the only payment method at the Event, has a single individual account balance and can only be used for noncash payments at the Event. Attendees are obliged to use at the Event only the payment methods and instruments established by the Organiser and its Partners. Payment with cash or bank card within the perimeter of the Event is strictly forbidden, outside the areas previously established by the Organiser*.

In the perimeter of the ARTmania 2024 Festival there will be 4 (four) Tag Payvent payment cards issuing, loading and reloading points, each with 2 sales stations. Their opening hours will be:

Note: After the end of the performances on each day of the festival, TOPUP Towers will no longer accept credit card charges, only refunds.

(Re)charging the Payvent Tag, in lei, can be done on the spot, at the specially arranged and signposted points, called TOPUP Towers, using cash or bank card. The reloading of the Tag entitles the holder to purchase Products and Services available at the Event. A card is issued free of charge.

Attendees can recharge their Payvent Tag as many times as they like. Each (re)charge must be for a minimum amount of 10 lei. The maximum value of a single (re)charge is 1,000 lei. Complaints about the charge can only be made to TOPUP Tower immediately after the (re)charge. After leaving the TOPUP Tower, no complaints are accepted.

The Attendee has the possibility to check the amount available on the Payvent Tag at any point of sale of the Contractual Partner who has the system installed or at the Organiser or at any TOPUP Tower at the Event.

No fee is charged for bank card payments. When (re)charging with a bank card, the balance is debited in lei and converted into the default currency of the debit/credit card at the issuing bank’s exchange rate for debit/credit cards other than lei.

During the Event, the Payvent Tag is considered an MPV (multipurpose voucher) payment instrument, as defined by the European Commission, due to the fact that in exchange for the Credit Points on the payment instrument, the attendee can only purchase Services or Products with different VAT rates during the Event. In this case, VAT is charged when the Credit Points are used. The issuance of a receipt and/or invoice for the Product/Service purchased is the responsibility of the Contractual Partners.

If an Attendee wishes to receive a tax invoice for the Products or Services purchased at the Event, he/she is obliged to keep all tax receipts from each individual Contract Partner in order to request a tax invoice from the respective Contract Partners at a later date.

Refund Policy for unused balance

Remaining unused balances may be redeemed in cash, through the process called Refund, only in accordance with the provisions of the “Terms and Conditions for Payvent Tag” and these Rules. Please take your time and read this document.

During the Event, the Organizer allows the withdrawal of unused balance as follows:

The refund procedure exclusively at the Event location consists in refunding the remaining amounts on the Payvent Tag, exclusively in cash, at any of the TOPUP Towers in the Event perimeter, during the period when the TOPUP Towers are open see detailed info above. In order to make the refund, the Attendee must present the tag and ensure that it does not show any signs of wear and tear (except in cases agreed by the Organiser). The final date for withdrawal of the balance is 31 July 2024, 00:59:59, at which time all TOPUP Towers will close.

The unused balance on the Payvent Tag and unrefunded (not requested to be refunded within the established refund period) remain the property of the Organiser and cannot be used in another edition of the Event.

We ask visitors not to leave the withdrawal of the final balance to the last minute.

The organizer does not assume responsibility for lost or damaged cards and will only refund the amount of money on a physical, undamaged card presented at the TOPUP Tower during the time it is in operation.

During the festival it is possible to pay with the Payvent Tag at the bars, food trailers and the official merchandise tent located in the perimeter of the event. Donations can also be made to the Hope & Homes Association account at its stand.

At Carturesti bookstore payment can be made only in cash or by bank card

  1. Intellectual Property

9.0. All materials presented on the website and on the media in the festival area are the property of the organizer or its partners.

All images, logos, texts in the festival area are reproduced with the consent of their owner (if they are not already assigned to the organizer).

All these elements are subject to intellectual property law.

9.1 Attendees may NOT use, copy, distribute, publish or incorporate, for the purpose of obtaining revenue, such items in other documents or materials in any form without the express prior written consent of the organiser or its partners.

9.2. The organizer has the right of image on the whole festival and can use the photo and video images, taken by its own staff and by attendees, in various materials produced during the festival.

9.3. By accepting the Terms and Conditions, attendees accept that the organizer, its partners, members of the press, other attendees and other persons allowed access to the festival may make audio and/or video recordings of the festival.

9.4 By accepting the Terms and Conditions, attendees give their consent to the recording and publication of their image, likeness and actions, understanding and agreeing that the organizer may store and duplicate the recordings and distribute/disseminate them by specific means, broadcast or otherwise make them public, including by informing the public of future editions of the festival, concerts and programs, by means of cable transmission or any other electronic (e.g. YouTube, Facebook, Instagram) or other means.

9.5. By accepting the Terms and Conditions, within the limits provided by law, attendees waive any financial or other claims against the organizer arising from actions such as the above.

9.6. Within the limits of the Terms and Conditions and the law, attendees have the right to make image, audio and/or video recordings during the festival by means of devices that do not contain, as a component part, prohibited objects and that do not represent, by themselves, prohibited objects.

9.7. Attendees who will make recordings during the festival are forbidden, without express prior written consent of the organizer, to sell them or use them for the purpose of obtaining money or other material benefits.

 

10. Organiser’s responsibility. Disputes
10.1. In addition to the above situations, the organiser does NOT assume liability for:

any claim raised by persons who enter the festival area without right or in breach of the Terms and Conditions or the law,

any claim regarding actions, omissions, events, etc., carried out outside the festival area,

any delay in evacuating the general public from the festival area, caused by them or other external factors,

the duration of the entry process in the festival area,

the modification of certain segments of the festival, necessary for its smooth running,

the artists’ performances,

the sudden and unannounced absence of any of the artists (the organizer assuming to take immediately all necessary measures for the smooth running of the festival),

the quality and/or conformity of products, services and merchandise marketed by partners,

any claim based on any act or omission on the part of another attendee, partner or other person not in any way connected with the organiser,

any claim based on an event caused by something for which the organiser is NOT legally responsible,

any claim when it is based on a case for which the law provides that the organiser is not liable,

any claim, in its entirety, when it is based on a cause of action for which the law provides for the limitation of the organiser’s liability.

In case the event is cancelled due to, but not limited to, acts of God, force majeure, strikes, natural disasters, weather phenomena, inaccessibility of the venue, the organizer may decide to partially or totally refund the cost of the tickets or postpone the event to a later date.

10.2. Any person who has claims against the organizer shall contact the organizer at its registered office in order to try to settle the dispute amicably.

If, after the attempt to settle the dispute amicably, no consensus is reached, it may be referred to the competent court.
